What does changing regulation mean for metal recycling companies?

Metal recycling companies operate in an environment where legislation and regulation are increasingly decisive in how material streams are processed and traded. Kiwa experts see that especially the WSR, End of Waste and WEEELABEX play a major role here. What does this mean for your organization?

WSR and cross border transport

The WSR (Waste Shipment Regulation, Dutch: EVOA) will enter into force on 21 May 2026 and applies to all waste streams crossing national borders. For metal recycling companies, this means that exporting waste is subject to additional requirements.

It’s now clear that waste materials listed on the green list have a postponement for the use of DIWASS until 1 January 2027 and that the existing Annex VII procedure continues to apply.

A key change is that the receiving company, if located outside the EU, must demonstrate in the destination country that the waste is properly processed. This is done through an audit at that company. In practice, this requires timely coordination and proper documentation.

End of Waste and market opportunities

End of Waste is relevant for metal recycling companies working with clean material streams. This certification can demonstrate that a material is no longer considered waste, but is classified as a raw material.

As a result, the WSR does not apply, which makes export easier. The material can also be supplied to parties that only accept raw materials. In practice, this often involves metal streams such as iron, steel, aluminum and copper.

WEEELABEX and processing of electronics

For metal recycling companies that collect and process discarded electrical and electronic equipment, WEEELABEX (Waste Electrical and Electronic Equipment Label of Excellence) applies once any processing activities are carried out on this equipment.

Although the rules have existed for some time, enforcement has been tightened in recent years. As a result, smaller companies are increasingly affected.
