The Construction Products Regulation (EU) No 305/2011 and 2024/3110 allows construction products to be placed on the market via European Technical Assessments (ETAs), which are drawn up on the basis of European Assessment Documents (EADs), even where harmonised European standards do not apply. What you need to know
As a manufacturer of innovative construction products, you often face the challenge of bringing your product to market because it is not yet covered by a harmonised European standard. To address this situation, the Construction Products Regulation sets out the procedure for obtaining the CE mark via European Technical Assessments (ETAs), in collaboration with the European Organisation for Technical Assessment (EOTA). As a Technical Assessment Body (TAB), Kiwa is a direct member of EOTA; we can therefore guide you through the process of obtaining the CE mark.
ETAs are drawn up on the basis of a European Assessment Document (EAD). EOTA has already included numerous innovative products in EADs, meaning that in many cases you can already draw on existing assessment documents. If there is no suitable EAD available yet, existing EADs can be adapted or created specifically for your construction product.
TAs provide a fully valid basis for CE marking. On the basis of the ETA, you can draw up a declaration of performance for your product and place your construction product on the European market. When an ETA is drawn up, the same conditions apply to the assessment and verification systems (AVCP and AVS) as for harmonised European standards.
If you need to optimise or revise your construction product, you do not need to apply for a new ETA. Such cases are already fully covered by the EOTA, and you can have your existing ETA updated by your designated TAB body to reflect the changes to your construction product. This ensures you can always present your customers with the most up-to-date performance data for your product.

Application for an ETA
The application form is the first step in the ETA process. Once the application has been submitted, we will check whether an ETA can be issued and whether this can be done on the basis of an existing EAD or whether a new EAD needs to be created.

Publication of documents
Information regarding the issuance of an ETA is publicly available on the EOTA website (ETAs | EOTA). It is not the ETA itself or its contents that are published, but rather a link containing the metadata (e.g. product name, manufacturer, issuing TAB body, etc.).
If a new EAD needs to be created in order to issue an ETA, this EAD is treated as confidential within the EOTA and the European Commission during the creation process. Once an EAD has been approved by the European Commission, it is published on the EOTA website and is freely accessible (EADs | EOTA).
Impact of the update to the Construction Products Regulation
New essential characteristics for sustainability and digitalisation
The update to the Construction Products Regulation places particular emphasis on sustainability and digitalisation.
Consequently, all newly drawn up EADs must now also include procedures for assessing the impact of construction products on specified predetermined environmental characteristics. It must also be ensured that the resulting ETAs fit within the Building Information Modelling (BIM) framework.
Existing EADs are also affected by this and must be gradually expanded and updated to include the new subject areas.
Validity of ETAs
With the update to the Construction Products Regulation, the validity period of ETAs is now limited. However, no fixed validity period has been set for ETAs; this is flexibly linked to the underlying EAD.
If an EAD is updated, withdrawn or replaced by a harmonised European standard, all ETAs issued on the basis of that version remain valid for a further five years.
Validity of EADs
With the update to the Construction Products Regulation, EADs are subject to a time limit. A newly created or updated EAD is valid for ten years until further notice. In the final year of this period, the EAD may be submitted to the European Commission for renewal.
Handling of ETAs based on ETAG
In the past, ETAs could be issued under the Construction Products Directive 89/106/EEC and the previous version of the Construction Products Regulation (EU) No 305/2011 on the basis of ETAGs (European Technical Approval Guidelines). ETAGs have since been replaced by EADs and, following the update of the Construction Products Regulation to Regulation (EU) No 2024/3110, can no longer be used as a basis for ETAs..
Existing ETAs based on ETAGs can no longer be used for CE marking and must be converted to be based on EADs. If you still have an ETA based on an ETAG, please contact the TAB body that issued it. If we have not previously managed the affected ETA on your behalf, we can work with you to carry out the conversion.
